Prenuptial, Postnuptial Transmutation and Cohabitation Agreements

Many people chose to contract into prenuptial agreements before marriage, and others may decide to contract into postnuptial agreements after marriage. When entering into such an agreement, one must have a clear understanding of the law as it applies to them without any such agreement before they decide whether or not to contract around what the law would otherwise provide. In California, individuals who are not married but live together may also chose to contract into a cohabitational agreement. Cohabitational agreements are similar to prenuptial agreements and postnuptial agreements but originate from a different legal analysis.
